The website www.banita.pt is intended for the dissemination of products, technical information and marketing of products by Banita, Lda., with headquarters at Praceta Palmira Bastos 34 - 4FT, 2625-481 Forte da Casa, Portugal, with the NIPC 514 006 048 and under that number registered in the Commercial Registry Office of Lisbon, hereinafter referred to as "Banita".

 

2. Scope of the Terms & Conditions

These Terms and Conditions apply to users of the www.banita.pt website and to any operations and transactions, of a commercial or other nature, carried out on this website. Navigation on the site, as well as the purchase of any article through Banita's online store, implies acceptance of these Terms and Conditions by the customer. Banita reserves the right to change these Terms & Conditions without prior notice, such changes being published in the Terms & Conditions area at www.banita.pt

 

3. Use and privacy of data

The use and processing of personal data on the website www.banita.pt is the responsibility of Banita in compliance with the General Regulation on Data Protection (RGPD) (EU) 2016/679.

Banita guarantees the security, privacy and confidentiality of personal and other data provided by its customers at the time of registration, order and/or payment at www.banita.pt, and such data and information is intended to be used by Banita for order processing and billing.

The data required for payment, as well as the selection inherent thereto, are duly protected through the encryption of the information provided by the customer, to whose content only Banita has access.

Customers have the right to access, rectify and cancel their data. Through the option "My account", you can consult or change your personal data, edit your address list or change your password. Banita will not sell or share your customer database with third parties.

5. Online pricing policy and product information

The data, prices and specifications present in this site are presented with merely informative effects, reserving Banita the right to modify at any time the information and commercial offer presented on: products, prices and promotional campaigns, commercial conditions and services.

The published prices are only valid for purchases made for Continental Portugal, Madeira, Azores and European Union, already including VAT at the applicable legal rate. You will also have to pay shipping costs. At the end of the order, the final price will be displayed, with all costs included for validation by the customer. The prices and specifications of products are subject to change without notice.

We make every effort to ensure that the information presented is free of errors and, whenever it occurs, we will proceed as soon as possible to correct it. The photos presented may not correspond to the settings described, and you should contact Banita for clarification and/or getting answers to your questions.

 

6. Online ordering and purchasing process

The completion of purchases in the Banita Online Store through the website www.banita.pt implies a registration by filling in the registration form available online.

Once registered, all you have to do is adding all the items you wish to purchase to the virtual shopping basket. You should follow all the steps of the purchase so that it is completed successfully. As soon as you finish your purchase, you will receive an automatic email confirming the transaction.

Banita processes the order made by a customer as follows:

  • Payment by MB, PayPal or Counter-Delivery - Up to 12 working hours after the confirmation of the respective payment.
  • Payment by bank transfer - Up to 12 working hours after the confirmation of the respective payment, that can be made by sending an email to info@banita.pt attaching the proof of bank transfer.
  • If this procedure is not carried out within 72 hours following the registration of the online order, Banita reserves the right to cancel the order.

The validation of the purchase order assumes that the customer has taken note and accepts the Conditions of Sale of the site http://www.banita.pt/TermsAndConditions

You can follow all the steps of the order in your customer area at www.banita.pt.

  • In payment: Period of confirmation of payment;
  • In preparation: Proof of payment made, goods to be prepared for shipment;
  • In transit: Shipped order. At this stage the order is in possession of the chosen carrier who will make the delivery.
  • Delivered: Order delivered by the carrier chosen and proof of delivery signed.
  • Cancelled: Order was cancelled by request of the client, or by decision of Banita for not fulfilling the requirements indicated in point 6.


Any error in the information transmitted by the customer, through this web page, will be the responsibility of the party sending the order, ie the customer. You must make your request for amendment or cancellation via e-mail: info@banita.pt

 

7.  Availability of products from online orders

The products presented in this site, are subject to availability and quality of existing stock. If there is no stock in our warehouse, the new stock will be imported from our European warehouse in Germany, which can take about 5 working days.

In the event that one of the items ordered is not available in stock, Banita will contact the customer by email or telephone in order to inform the new delivery time.

In case of refusal by the customer, Banita will cancel the order and refund the amount paid, including the shipping costs, if the payment has already been made and proven.

 

8.  Home delivery of online orders.

The products purchased on the site are delivered in mainland Portugal and European Union through the company Chronopost/DPD and in Madeira and Azores only through AbreuCarga.

Banita undertakes to deliver the orders to the carrier chosen by the customer, properly packed, within 24 hours after the confirmation of payment by the bank or the customer, not being responsible for any delays by the carriers in the delivery of the same.

Banita only does expedition during working days. This way, neither weekends nor holidays are counted for estimated delivery of orders. After the confirmation of payment of the order or the order confirmed on the site, is initiated the process of preparation of it. You can at any time track the status of the order in your reserved customer area on the site, if you have registered.

Deliveries through Chronopost services are made on working days until 7pm at the address indicated by the customer. You must ensure that there is someone at the address you indicated to receive the order and sign the proof of delivery. If no one is available to receive the order, one more attempt will be made, after this attempt the order will remain in the nearest Pickup Shop for 5 days so that it can be picked up by the customer. Deliveries only available to mainland Portugal and the European Union. No deliveries are made to PO Boxes.

If you have chosen to make your payment against delivery, you must have the right value in cash to make payment at the time of delivery of the order.

In all cases, whenever an order is returned for non-compliance of the recipient, in this case, the customer, is obliged to pay all costs of return, as well as the costs of returning the goods.

The estimates of the dates of dispatch and delivery are merely indicative. Any delay in the shipment of items, compared to the dates of estimate presented, does not confer the right to compensation. The delivery dates are the sole responsibility of the carriers. The customer is obliged to check the proper receipt of the order and the condition of the goods received. If a non-conformity is found in the product received, the customer must report it by email: info@banita.pt

  • Identifying the number of the invoice/receipt and the non-conformity verified, attaching a demonstrative photograph.

 

9. Methods of payment

To pay for purchases made in the Banita Online Store, the customer has the following means:

  1. MB - MultiBanco
  2. PayPal - Visa - Mastercard
  3. Bank transfer to IBAN - PT50 0010 0000 5411 2990 0011 9 (BPI Bank)
  4. Cash on delivery to Chronopost or AbreuCarga

Transfer: If the payment is made by Bank Transfer, the customer will have a time limit of 72 hours to make the payment on a Multibanco platform or on his Homebanking on the Internet.

As long as the payment is not confirmed, the orders placed with this option on the website will be in "Payment" mode. If the payment is not made within the stipulated period, Banita reserves the right to cancel the orders.

In order for the order to be processed, the customer must send an email to info@banita.pt attaching the proof of bank transfer.

 

10. Banita return and refund policy

10.1 Return:

Customer satisfaction first! Hygiene with a smile.

If for any reason you are dissatisfied with our products, you can cancel your order and return the product(s) within fourteen days from the date of receipt of the order. We return the total value of products ordered and returned.

It is the responsibility of the customer to notify us, within the referenced period, by e-mail or mail-letter, of his intention to cancel and explaining the reason. Banita undertakes to provide a reply within 48 working hours of receiving the request.

The goods must be returned in original condition and with the original packaging.

The cost of their return is our responsibility.

Also in the event that the customer has received damaged items or with technical problems, Banita will provide a means of return, without any charges to the customer.

10.2 Refund:

In the case of return of a product purchased in the Banita Online Store, under the terms and conditions set forth above, Banita will refund, if there is no possibility of exchanging the items, the customer, the price corresponding to the items purchased within a maximum of 5 working days after the return and by bank transfer to IBAN to be indicated by the customer. Banita reserves the right not to accept items that do not comply with the conditions referred to in point 10.1.

11. After Sales Service - Warranty

All our products come with guarantee against manufacturing defects for two years from the date of purchase. The warranty does not include defects caused by misuse or usual wear and tear.

If a non-conformity is found in the product purchased in the Banita Online Store during the period of the legal guarantee, the customer must make the respective complaint through the means referred to above, identifying the number of the invoice/receipt and the non-conformity found. The warranty period starts from the date of issue of the invoice.

14. Applicable Legislation

All purchases made on the website www.banita.pt are subject to Portuguese legislation.

Any conflict or divergence of interpretation of the Terms & Conditions will be submitted to the competent Portuguese Court, in principle the court of Vila Franca de Xira - Lisboa.

If the Customer is outside mainland Portugal, Banita hereby informs that any legal process must be forwarded to the Portuguese Courts.
